Density Bonus Program Review

The District of Lake Country introduced a density bonus program in 2010 to direct contributions from developers to the Fire Facilities and Equipment Reserve Fund in exchange for bonus density and height in applicable residential, commercial and comprehensive development zones. On April 25, 2024, the Housing Statues Amendment Act, 2024, received Royal Assent, introducing new requirements for municipalities and density bonus programs.

The District is revising its program to comply with the following legislative requirements:

• Financial feasibility analysis – local governments must conduct a financial feasibility analysis to inform density bonusing requirements.
• Form of contribution – local governments must structure programs to facilitate the delivery of affordable housing units via built units, with an alternative option to provide cash-in-lieu.
• Engagement – local governments must consult with affected parties when developing or amending density bonusing bylaws.
• Annual reporting – local governments must report annually to the province on density bonusing programs.

In addition to meeting legislative requirements, the new program will enhance support for funding amenities as outlined in Policy 3.7.1.3.3 in the Official Community Plan.
